Full Terms and Conditions Registration of an account with RAVen Soft or NTSP indicates your immediate acceptance of these terms an conditions. Terminology The terms Neo Tokyo Skies Prologue and NTSP will be used interchangeably in these terms and conditions. Both instances refer to Neo Tokyo Skies Prologue and its associated resources. The terms RAVen Soft, and RAVen Soft Design may also be used interchangeably in these terms and conditions. Both instances refer to RAVEN-SOFT DESIGN LIMITED of England and Wales. Service Conditions of Play To participate in NTSP play every user must accept these terms and conditions and have completed the account activation process. An account should not be activated if you you do not accept the terms laid out in this document. Liability RAVen Soft will make every attempt to ensure that an uninterrupted service is available, however, in some cases it, due to circumstances beyond our control, disruption of service may occur. This includes but is not limited to server breakdown and game engine bugs. RAVen Soft will not be liable in any way for any service disruption. RAVen Soft will also not be held liable for any disadvantages that an account may suffer due to said disruptions. NTSP Membership Membership Membership commences as soon as you register for an NTSP account. All users must store a valid e-mail address with their account at all times. RAVen Soft reserves the right to test an e-mail addresses validly at any time. Termination of Membership by the User A user may terminate their account at any time by deleting it. No personal data will be retained by RAVen Soft. Termination by RAVen Soft No user has any claim to take part in any RAVen Soft services. RAVen Soft reserves the right to delete or block/ban any accounts entirely at its own discretion. Such instances may occur, but are not exclusively limited to instances where a user is acting in an inappropriate way or they have violated the terms and conditions of this agreement. RAVen Soft will accept no legal claim for account termination. Contents / Responsibility NTSP acts as a platform that allows users to communicate with each other. All users are responsible for their content of their communications and RAVen Soft will not be held liable for said content. Any communication that are of a pornographic, offensive, or illegal nature are strictly not permitted. Any user seen to violate such restrictions could face account termination. Unacceptable Actions Entering NTSP Entering into NTSP is only permitted through the http://www.neotokyoskies.co.uk/portal.aspx page. Entering into the site through any other means is strictly prohibited even if said means displays the aforementioned page. Manipulation All users are prohibited from using any mechanism or software in conjunction with the NTSP or RAVen Soft websites that could interfere with the function or development of the game. Users are not permitted to take actions which cause an excessive use of system resources, this includes but is not limited to excessive refreshes and multiple windowing. Users are not permitted to block, edit or overwrite any content that has been created by RAVen Soft for use within or outside of the game. External Programs and Bots It is strictly prohibited to use any external programs or bots with any RAVen Soft or NTSP service other than a standard internet browser. Any accounts seen to do so will immediately be terminated. Bots include but are not limited to any programs, scripts or tools that interfere with, simulate or replace parts of a RAVen Soft or NTSP system or service. This non exclusively includes integrated browser features, firewall systems and anti virus software. The usage of software that blocks advertisement is also prohibited ether intentionally or other external means. NTSP Usage Restrictions Number of accounts NTSP accounts are strictly limited to one per person. Any users found to be using multiple accounts will have all said accounts block or deleted without warning. Acceptable Behaviour At the discretion of RAVen Soft, any users that are deemed to be behaving in a way that is detrimental the progression or growth of NTSP may be banned. Such instances include but are not limited to griefing other players, exploiting system bugs or using excessive amounts of system resources. Data Protection Collection and Storage of Personal Data RAVen Soft securely collects and stores personal data under the terms of the UK Data Protection Act. This data is used entirely for the purposes of supporting its services and will never be passed on to a third party except where required to by UK law. Information gathered includes names and e-mail addresses, the IP address of connections, session times, browser types and all information entered by the user into their profile. A user is entitled to object to the storage of any of the above information, however, said information is required in order to run a RAVen Soft and NTSP account. In such instances where a user objects their account will be deleted and all personal information will be removed from RAVen Soft and NTSP servers. Ownership and Rights of Accounts General All accounts including their associated resources, internal funds and units etc. are all virtual objects of NTSP and all rights are reserved by RAVen Soft. The user has no ownership or any other rights to their account. Prohibition of exploitation Without prior written permission of RAVen Soft no user is permitted to agree with a third party upon the transfer or utilization of an account or any of its associated virtual objects and data. This in particular includes the sale of accounts and resources. It strictly prohibited for anyone other than RAVen Soft to sell access rights to NTSP or any of its services. Violations of these or any other rights of RAVen Soft, including copyright theft will be reported to the appropriate authorities and prosecuted. Exceptions Internal trading between internal NTSP accounts is not prohibited provided it is free of charge and not for monetary exploitation. Liability RAVen Soft is not liable for any damages caused by the use of NTSP or any of its other software or services except for damages that were caused wilfully or by gross negligence. RAVen soft therefore offers the following health warning: Always play in a well lit environment. Take a 15 minute break for every hour of play. Discontinue playing if you experience any dizziness, nausea, fatigue or have a headache. Some individuals are sensitive to flickering lights, geometric shapes and patterns and or may have an undetected epileptic conditions, always consult your doctor before playing any form of computer game. Always play online responsibility, take all appropriate breaks to eat, rest and sleep. Modification to These Terms and Conditions RAVen Soft reserves the right to modify or extend these terms and conditions at any time. Should any changes be made notification will be published no less than two weeks before the new terms come into effect. Continued use of any associated RAVen Soft services after this period indicates an acceptance of the modified terms and conditions. Applicable law All RAVen Soft services are provided in compliance with the laws of England and Wales. All disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Those who access the site from other locations are responsible for compliance with their local laws as aplicable. Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales under English Law.
